2. Acceptance of these terms

By creating an account and using this service, you agree to these Terms of Service. If you do not agree, you must not use the service.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials. You must not share your account or allow others to access it. You must provide accurate information when registering.

4. User-generated content

4.1 You own your content

Sites and content you create using BeanSpell remain yours. We do not claim ownership over your content.

4.2 Licence you grant us

By publishing a site through BeanSpell, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, and serve your content. This licence ends when you delete the site or your account, subject to technical limitations such as backups.

4.3 Your responsibility

You are solely responsible for the content you publish. By using BeanSpell you represent and warrant that you own the content or have obtained all necessary rights, and that the content does not infringe any third-party intellectual property rights or applicable laws.

4.4 AI-assisted content

BeanSpell allows integration with AI tools via MCP (Model Context Protocol). We do not provide AI services ourselves. You remain fully responsible for any content published, regardless of how it was created.

5. Prohibited use

You must not use BeanSpell to publish content that:

• infringes copyright, trademark, or other intellectual property rights;
• is unlawful, defamatory, abusive, or harassing;
• contains personal data of others without their consent or legal basis.

6. Fair use of hosting resources

Each plan includes a storage and bandwidth allowance per site, intended for normal use of a brochure website or blog, well beyond what a typical small-business site needs:

These limits apply per site, not per account — a plan that includes multiple sites (Pro, Team, Studio) allows this allowance for each site included in that plan.

This service is not designed to host content that generates storage or bandwidth usage far beyond these figures — for example, using it as a general file-hosting service, or sustaining monthly traffic well above your plan's allowance.

We measure storage and bandwidth usage per site so that usage significantly and consistently above these figures can be identified. Enforcement is not necessarily automatic or immediate — we reserve the right to act on measured usage data even where a limit was not blocked in real time. If your usage exceeds your plan's allowance, we may contact you to discuss it, offer a plan better suited to your needs, or, where necessary, limit, throttle, or suspend access to protect the service for other users.

7. Disclaimer of warranties

This service is provided “as is” and “as available”, without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that content will remain available permanently.

8. Limitation of liability

To the extent permitted by applicable law, we exclude liability for slight negligence. This limitation does not apply to intent (Vorsatz), gross negligence (grobe Fahrlässigkeit), or injury to life, body, or health.

9. Termination

You may delete your account at any time via your account settings. We may suspend or terminate your account if you materially breach these Terms, including the fair use policy in Section 6.

10. Changes to these terms

We may update these Terms from time to time. The current version will always be available on this page. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the Federal Republic of Germany. For users in the European Union, mandatory consumer protection provisions of your country of residence remain unaffected.
